These EU/UK Disclosures apply when you access or use our website, mobile applications, retail services, online marketplace, consignment services, buyout services, authentication services, customer support, communications, or related services from the European Union, European Economic Area, or United Kingdom.
Saconde is established and primarily operates in the United States. The availability of our website or application in a particular country does not necessarily mean that Saconde actively markets, ships, purchases, consigns, or provides every service in that country.
Certain products, seller programs, payment methods, shipping options, promotions, or application features may not be available in all EU, EEA, or UK locations.
We may restrict, refuse, suspend, or cancel transactions where:

Unless the product page or order confirmation clearly identifies a third-party professional trader as the seller, consumers should understand that their purchase contract is ordinarily formed with Saconde.
Private individuals who sell or consign items to Saconde do not necessarily act as professional traders. Consumer rights that apply to purchases from professional traders may not apply in the same manner to a direct transaction with a private individual. Where Saconde is the contracting seller, however, Saconde will honor consumer rights that apply to Saconde under mandatory law.
Before an EU, EEA, or UK consumer places an order, Saconde will make available, as applicable:
The product listing, checkout screen, linked policies, and order confirmation collectively form part of the pre-contract information.
Customers must review the full item description, photographs, measurements, condition report, disclosed defects, included accessories, price, currency, shipping terms, and estimated duties before submitting an order.
Products displayed on the website or application are invitations to submit an order and are not necessarily binding offers.
A customer submits an offer to purchase by completing checkout and selecting the button or control indicating that the order carries an obligation to pay.
Receipt of an automated order acknowledgment does not necessarily mean that the order has been accepted. A binding contract is formed when Saconde:
Saconde may decline or cancel an order before acceptance because of inventory error, pricing error, suspected fraud, sanctions concerns, payment failure, inability to ship, legal restriction, authentication concern, item damage, or another legitimate reason.
If Saconde cancels an order after receiving payment, Saconde will return the applicable amount using the original payment method or another lawful method, subject to fraud, chargeback, sanctions, or legal restrictions.
Prices may be displayed in U.S. dollars or another supported currency. Currency conversion estimates are provided for convenience and may differ from the amount charged by a payment provider or card issuer.
The final checkout page will identify the amount charged by Saconde. Banks, card issuers, payment processors, or other providers may impose conversion fees, international transaction fees, or other charges that Saconde does not control.
For international shipments:
Where checkout identifies a shipment as “duties paid,” “taxes included,” “DDP,” or similar, Saconde or its logistics provider will arrange payment of the identified import charges. Where checkout identifies a shipment as “duties unpaid,” “taxes not included,” “DAP,” or similar, the recipient is responsible for import charges.
Most Saconde merchandise is pre-owned, vintage, rare, limited, discontinued, or otherwise unique.
Normal wear, aging, patina, prior repair, odor, storage marks, hardware wear, creasing, color variation, minor scratches, or other characteristics may be consistent with a pre-owned item. Such characteristics will not constitute a lack of conformity when they were clearly disclosed, reasonably visible, expressly accepted, or reasonably expected considering the item’s age, price, description, and pre-owned nature.
Product photographs may be enlarged to show condition. Screen settings and lighting may affect color appearance.
Nothing in this section excludes liability for an item that fails to conform to mandatory consumer-law requirements.
Subject to the exclusions below, an EU or EEA consumer may withdraw from an eligible distance purchase without giving a reason within 14 days after the day on which the consumer, or a person designated by the consumer other than the carrier, acquires physical possession of the goods.
For an order containing multiple items delivered separately, the period generally begins after receipt of the final item.
To exercise the right of withdrawal, the consumer must send Saconde a clear statement before the withdrawal period expires.

The consumer may use the model withdrawal form at the end of these EU/UK Disclosures, but use of the form is not mandatory.
Return deadline
After notifying Saconde of withdrawal, the consumer must return the goods without undue delay and no later than 14 days after communicating the decision to withdraw.
Saconde will provide return instructions. Returns must be sent to the address specified in those instructions and not necessarily to the showroom address above.
Return costs
Unless Saconde agrees otherwise or failed to disclose the consumer’s responsibility, the consumer is responsible for the direct cost of returning the item.
Because Saconde deals in high-value merchandise, the consumer should use a trackable, insured, and appropriately secured shipping method. The consumer remains responsible for the return until it is delivered to the designated return location, except to the extent mandatory law provides otherwise.
Refund timing
Saconde will reimburse eligible payments received from the consumer, including the least expensive standard outbound delivery charge offered for the order, without undue delay and generally within 14 days after receiving the withdrawal notice.
Saconde may withhold reimbursement until it receives the returned item or the consumer provides evidence that the item was sent, whichever occurs first.
Saconde may exclude additional delivery costs resulting from the consumer’s selection of an expedited or premium delivery method.
The refund will ordinarily be issued using the original payment method unless the consumer expressly agrees otherwise and does not incur additional fees as a result.
Diminished value
The consumer is responsible for diminished value resulting from handling beyond what is necessary to establish the item’s nature, characteristics, condition, authenticity indicators, and functioning.
Removal, alteration, or damage to Saconde tags, security devices, authenticity seals, return labels, serial-number records, protective materials, or included accessories may result in a lawful deduction if the conduct diminished the value of the item.
The right of withdrawal is not a right to use, wear, alter, repair, clean, transfer, or resell an item before returning it.
Subject to applicable exclusions, a UK consumer may cancel an eligible distance purchase within 14 days after the day on which the consumer, or a person identified by the consumer other than the carrier, takes physical possession of the goods.
The notice, return, cost, reimbursement, and diminished-value provisions in Section 8 apply to UK cancellations to the extent consistent with UK law.
Nothing in Saconde’s policies reduces any longer or additional remedy that applies where goods are faulty, misdescribed, not fit for purpose, or otherwise fail to conform to the contract.
A statutory withdrawal or cancellation right may not apply, or may end early, where permitted by applicable law, including for:
An item is not excluded merely because it is pre-owned, luxury, discounted, marked “final sale,” sold through an application, or authenticated. “Final sale” language does not override a mandatory statutory cancellation right.
Withdrawal or change-of-mind rights are separate from a consumer’s remedies for defective, damaged, misdescribed, inauthentic, or nonconforming goods.
Where mandatory EU, EEA, or UK consumer law applies, Saconde will provide the remedies required by that law. Depending on the circumstances, these may include repair, replacement, price reduction, rejection, cancellation, or refund.

For unique pre-owned goods, an identical replacement may not be available. Where replacement is impossible, another legally required remedy will be offered.
Consumers should notify Saconde promptly and provide photographs, video, packaging, shipment records, and other information reasonably necessary to investigate the claim. Failure to notify Saconde immediately does not waive a mandatory right where applicable law provides otherwise.
Saconde evaluates authenticity using internal personnel, available documentation, technology, databases, third-party authenticators, and other methods that Saconde considers appropriate.
If a consumer reasonably believes an item is inauthentic, the consumer should stop using or transferring the item and contact hello@saconde.com with:
Saconde may require return of the item for inspection. Saconde may reject unsupported, altered, substituted, or fraudulent claims.
Nothing in this section limits mandatory remedies for goods that do not conform to their description.
Estimated delivery dates are estimates unless Saconde expressly agrees to a guaranteed date.
Risk of accidental loss generally passes as provided by applicable law. For consumer shipments arranged by Saconde, risk ordinarily remains with the contracting seller until the consumer or the consumer’s designated recipient takes physical possession, except where the consumer independently appoints a carrier not offered by Saconde and mandatory law permits risk to pass upon delivery to that carrier.

Saconde will attempt to respond within a reasonable time. Complex authenticity, payment, customs, fraud, or carrier matters may require additional investigation.
The European Commission’s former Online Dispute Resolution platform has been discontinued. Saconde does not represent that it participates in any particular EU or UK alternative dispute-resolution body unless Saconde expressly identifies that body in writing.
Consumers may contact an applicable national consumer authority, approved alternative dispute-resolution provider, local trading standards authority, or court where legally available.
Saconde’s applicable Terms may select New York law and a dispute forum. That selection does not deprive an EU, EEA, or UK consumer of mandatory protections that apply under the law of the consumer’s habitual residence and cannot lawfully be waived by contract.
Any arbitration, class-action waiver, limitation of liability, disclaimer, shortened claim period, or forum provision applies only to the extent enforceable under applicable law.

Saconde may act as a processor or service provider where it processes information solely on documented instructions from another controller. Where Saconde acts only as a processor, the applicable controller’s privacy notice governs the processing.
